1.IDENTITY M BY MARIJKE
Little Stories Jewelry // M by Marijke
These General Conditions apply to every offer of M by Marijke, every order and to every Agreement concluded between M by Marijke and the Consumer.
This document (General Conditions of Sale) defines the terms and conditions applicable to sales concluded between on the one hand any person who visits the site www.mbymarijke.com, hereinafter referred to as the user (s) and on the other hand the company M by Marijke.
Consequently, by visiting and using the site www.mbymarijke.com, users agree to abide by all the conditions specified herein. Users should take into account that these general conditions may be updated at any time. Therefore, they should consult this page regularly in order to keep abreast of any changes to the terms and conditions specified.
Consumer is obliged to accept the General Terms and Conditions before concluding the Agreement. Placing an order through the Webshop and checking the text: ‘I have read and agree to the website terms and conditions’ is the acceptance of the General Terms and Conditions.
No person who is considered incompetent, in particular within the meaning of Article 1123 et seq. of the Civil Code, shall under any circumstances purchase articles on this site.
The products offered for sale on the webshop www.mbymarijke.com are made of 14 carat gold (white, yellow or rose), whether or not set with diamonds or sapphires.
The jewels are as much as possible predefined on the webshop of M by Marijke by means of photos, text… This allows users to familiarize themselves with the essential characteristics before placing an order. Users acknowledge that their acceptance is based on these descriptions.
When the user confirms an order, it means that the user accepts these conditions of sale, acknowledges having read them in full and agrees to waive the application of any other conditions.
Once an order is validated on the webshop, the user acknowledges that his acceptance constitutes a firm and irrevocable commitment: the sale is considered completed and payment is due immediately by the user.
The company M by Marijke will send an e-mail confirming the order. This email only confirms receipt of the order.
Once an order is confirmed, the production time for making each item is approximately 1 to 2 weeks. M by Marijke will inform the user by email when the order will be shipped.
No sales contract will exist between the parties until M by Marijke has confirmed by e-mail that the ordered products have been shipped to the user.
M by Marijke reserves the right to cancel or refuse any order from a user with whom a dispute may exist regarding the payment of a previous order or who, in the opinion of the company M by Marijke, may pose a risk.
M by Marijke undertakes to comply with orders placed on its site. If one or more items ordered are not available, the company undertakes to immediately inform the user of their unavailability and, if applicable, to reimburse the user within a period of 14 days of payment of the amount due. The user’s order will then be automatically cancelled.
All prices on the web shop are expressed in euros, including all taxes and excluding any delivery costs.
The prices of the articles proposed on the webshop www.mbymarijke.com are valid for 24 hours after their publication on the site. Products are invoiced on the basis of the prices in force at the time the order is placed.
Products remain the property of the company M by Marijke until full payment has been received.
M by Marijke will do everything to ensure that all details, descriptions and prices on the webshop are correct, but missing is human. If an error is found in the price of the items ordered by the user, M by Marijke will inform the user as soon as possible by e-mail and offer him or her the possibility to reconfirm the order at the actual price or to cancel it.
Payment is due by the user immediately after the order is placed.
VAT payment terms:
Unless otherwise stated, prices listed on the site include VAT at the Belgian tax rate.
– Items shipped to Belgium:
Consumers and businesses: sales include VAT at the Belgian rate of 21%.
– Articles sent to another country of the European Community:
Consumers: the sale includes VAT at the Belgian rate of 21%.
Companies: the sale is exclusive of VAT
5. OWNERSHIP RISKS
Ownership of products only passes upon receipt of full payment of the product price.
In the case of items sold to a consumer or company (within the meaning of the Belgian law of April 6, 2010 on market practices and consumer protection), the risk is transferred when the product is delivered to the user.
The date indicated on the delivery document constitutes valid proof of the delivery date.
6. SHIPMENT AND DELIVERY
Since a large part of the jewelry sold by M by Marijke is custom made, the production time for jewelry ordered on the site is about 1 to 2 weeks from the confirmation of the order.
This production time is provided for information purposes only.
M by Marijke is not liable in case of delays, loss of ordered products or strikes due to the postal services or the carrier. In such cases, the user must take the appropriate action directly with the postal service or carrier.
Another email will be sent to the user when her/his package has been dispatched.
Delivery is made anywhere within the Benelux.
Products are delivered to the address provided by the user at the time the order is placed.
Products will only be delivered during working hours. Users should note that orders registered on the site on Friday afternoon will not be processed until the following Monday.
Users should check the packaging and products upon delivery.
Any problems related to the delivered items (damaged, missing items, broken or defective items, etc.) Must be reported within 3 days (including weekends and holidays) of delivery. This notification, which states all reservations and claims of the user regarding the non-conformity of the delivered products or defects, must be sent by e-mail to: email@example.com
No claims will be accepted after this period.
7. RETURNS AND WARRANTY
In accordance with the Belgian law on market practices and consumer protection of April 6, 2010, since the items sold on www.mbymarijke.com are custom made according to the personal specifications of the customer, the customer has no right to cancel the purchase ( right of withdrawal).
However if the customer is dissatisfied with his or her choice it can be exchanged for another product or a gift certificate within the 14 days. (if these are not personalized with an engraving / fingerprint)
In no case will the customer be refunded.
Shipping costs for the exchange will be at the customer’s expense.
Once an order is validated on the site, users acknowledge that the transaction has been accepted in full compliance with the description of the jewelry sold and constitutes a firm and irrevocable commitment. The sale is then considered completed and the purchase price is immediately due. From that moment on, the user has no right of withdrawal.
Each piece of jewelry comes with a six-month warranty. Should something happen to your jewel during this period, the necessary repair will be carried out free of charge upon presentation of the certificate provided.
The warranty does not apply if:
The Consumer has repaired and/or modified the delivered products himself or has had them repaired and/or modified by third parties.
The delivered products have been exposed to abnormal conditions or otherwise carelessly handled.
The warranty does not entitle you to replacement or refund for lost or stolen items.
M by Marijke is not liable for any delay or non-execution of the order due to a technical problem or any other cause beyond its control. In such cases M by Marijke has the right to postpone the shipment and delivery or cancel the order.
M by Marijke is in no case liable for any inconvenience or damage inherent in the use of the Internet, in particular connection interruptions, external interference or the presence of computer viruses, or other cases of force majeure.
The company M by Marijke does not guarantee the accuracy of the information posted on this site and accepts no liability for any damages incurred as a result of inaccuracies, including direct and consequential damages, or loss of enjoyment resulting from the use of the site.
The company M by Marijke reserves the right to make changes to its site and content, including rates, descriptions and inventory, at any time without notifying users whether or not they are registered on the site. The photos and illustrations of products on the Internet site www.mbymarijke.com are the property of M by Marijke.
The company M by Marijke reserves the right to withdraw or modify certain services or features of the site without notice. The company reserves the right at any time and for any reason to modify or interrupt access to the site temporarily or permanently, in whole or in part, without informing users. The company M by Marijke shall not be liable for any direct or consequential damage in connection with any modification, suspension or interruption of access to the site. In addition, the company M by Marijke may restrict access to certain parts or to the entire site.
The company M by Marijke is not liable for fraud or negligence committed by employees, subcontractors and implementing agencies.
9. INTELLECTUAL PROPERTY
All jewelry creations, texts, comments, illustrations and images reproduced on www.mbymarijke.com are the exclusive property of the latter.
M by Marijke is a registered trademark, exclusively owned by the company Little Stories Jewelry // M by Marijke. Users are not authorized to use this trademark in any way and they agree not to use this trademark or similar trademarks without the prior written consent of the company.
10. CONFIDENTIALITY POLICY
In accordance with the Belgian law of 8 December 1992 on the protection of privacy with regard to the processing of personal data, www.mbymarijke.com undertakes to protect the privacy of its users.
The user information and data requested when ordering on the webshop are necessary for the registration and follow-up of orders and to ensure that the company’s business is efficiently managed. By using the webshop, users agree that their personal data may be processed on the basis described below and guarantee that all data provided by them is correct.
This includes the following data: last name, first name, date of birth, email address, address, country, telephone number, credit card number and expiration date.
M by Marijke reserves the right to keep track of the user date.
When users visit the webshop or send emails to M by Marijke, they agree to receive electronic communications from M by Marijke, such as newsletters.
Unsubscribing from these newsletters can be done by clicking on the link at the bottom of each newsletter.
These cookies are used to collect information on the pages of the site and the aspects consulted in an anonymous manner.
The information collected is not linked to any other information that would make it possible to identify the user, but the information is collected to be able to inform M by Marijke about how potential customers use the webshop. The identity of the user is not known to M by Marijke until the user places an order.
While you browse the Website, we store cookies on your computer’s browser directory. Our reasons for using cookies in this manner are two – fold: to improve your Website experience by, for example, keeping you logged in as you shop, or holding the items in your virtual shopping cart; and by enabling us to provide you with advertisements which offer products and/or services that may be of interest to you, based on your browsing history. Also, the Website’s cookies will enable 3rd parties to collect information regarding the Website’s users, such as their IP addresses. Kindly note however that any information collected by 3rd parties from cookies will never identify any Website user personally.
Which types of cookies do you use?
The Website uses advertisement and targeting cookies, and functionality cookies. We use advertisement/targeting cookies to deliver ads to the Website’s users. These cookies also impose limits on the number of times a user is exposed to certain ads, while measuring their efficacy at the same time. We use functionality cookies so that the Website can retain memory of certain choices its users make. We use Google Analytics for two reasons: to assess the Website’s general effectiveness; and to ascertain the ways in which the Website may be upgraded for its users’ benefit. Please note that we have signed a processor agreement with Google, which means Google will never use the information it collects through the cookies the Website uses (irrespective of whether such information is personally identifying) for any reason.
Does the Website have a social media presence?
The Website contains links to Facebook and Instagram. The companies of these social media platforms integrate cookies into the codes of any links which direct persons to their respective websites; this is entirely beyond our control. We accordingly recommend that you frequently read the Privacy Policies of Facebook and Instagram to be informed as to how these social media platforms collect and use your information through cookies.
